The Execution of a Kurdish Political Prisoner & Releasing the Audio File of His Defence Statements

Just two days after the execution of three Kurdish political prisoners known as Ramin Hossein Panahi, Loghman and Zanyar Moradi, the death penalty of another political prisoner called Kamal Ahmad Nejad was carried out on early Monday, September 10, at Miandoab Central Prison.
Kamal Ahmad Nejad (from the village of Gamishgolli Miandoab in west Azerbaijan) was arrested In fall 2015 along with five other prisoners known as Milad Abdi, Saeed Siahi, Soleyman Kerry, Mostafa Tahazadeh and Halmat Abdollahi) on the charge of killing a member of the Basij (Mobilisation Force). They were transferred to Miandoab Prison after 6 months of interrogation and torture at the solitary confinement cells of Intelligence Office.
Later in 2015, they were sentenced to eight months in prison on another charge, namely cooperating with Kurdish parties, Five of these prisoners were notified of this sentence too late to be able to contest it, but another prisoner (who had the chance to contest the sentence before the deadline) was acquitted of the charge by the Court of Appeals.
The trial of these prisoners was held at the Miandoab Criminal Court (Branch 1) in August of this year for the murder of a member of Basij. Despite witnesses, who could testify that none of these prisoners were present at the murder scene on the day of the murder, the court issued a final verdict for the accused prisoners without summoning the witnesses and considering the defence statement of their lawyer. Kamal Ahmad Nejad was sentenced to Qesas (retaliation in kind) as the main defendant, and the other five prisoners were sentenced to 15 years in prison for involvement in the murder.
These sentences were issued while Kamal Ahmad Nejad, the main accused of the case had repeatedly told Kurdistan Human Rights Network (KHRN) that he was innocent but the Ministry of Intelligence and the Revolutionary Guards insisted on enforcing his death sentence.
In December 2016, this prisoner wrote an open letter to the UN Human Rights Special Rapporteur on Iran’s affairs and described his arrest and tortures at the Ministry of Intelligence Detention Centre to force him make television confessions and explain the reasons underlying the issuance of such verdict against him.
“I did not even know why I had been arrested”, he states in part of this letter, in which he clearly mentions that the charges against him were fabricated on the order of the Ministry of Intelligence. In this letter, he also explains the status of the prison and the torture he suffered: I was held in solitary confinement and tortured for six months to endure sadness, darkness and despair. These solitary confinement cells are made to psychologically destroy human beings and would turn any normal citizen into a savage criminal. I underwent six months of physical, moral and psychological tortures. My torturers did everything they could to force me confess to murder. Most of the time, I was under torture and I was not aware of what was happening. But I then realised that I was kept along with 5 other citizens from the village of Gamish Goli. Two of them had been actually arrested two months before I was arrested. The brutality of the guards was unimaginable. During that period, I prayed 100 times a day to die and my sufferings end. I was on the verge of becoming mad and I constantly asked myself why such things were happening to me.
In this letter, Kamal Ahmad Nejad further states that he was forced to confess to killing of the concerned Basij member due to the severity of the torture and misconduct that he had suffered in prison for months. “Such torture ultimately led me to accept the charge while making a TV confession on “Press TV” and admitting to something about which I really had no idea.”, he states. Such torture included beatings, hanging, whipping by cables, electric shocks, family threats and verbal abuse. Finally, the aforementioned prisoner had no other choice but to accept the allegations in full as he could not bear the tortures anymore.
‘Finally, I resigned myself to confess to a murder I did not commit due to the physical tortures and death threats and I agreed to make the TV confession broadcasted by Press TV. The text of The TV confession was entirely written by my torturers. A few days before the ‘interview’ on Press TV, they forced me, with more brutality than ever, to memorise the script to be able to recite it live on TV”, he mentions in this letter.

The sentence served on him was enforced on Monday, September 10, despite the complete denial of the charges. He is the fourth Kurdish political prisoner to be executed in September this year.
