The court of appeal must go on the prosecutor's line and impose the strictest possible punishment. If a lot of rape against a child does not give maxstraff when should max penalty be used?

At the beginning of July, the District Court sentenced a couple of people who had been employed at a low and middle school school in a smaller town in Western Sweden for serious rape against children and gross child pornography. The man and woman were given 12 and 10 years in prison respectively. For several years they have relied on a minor girl they had been responsible for through social services. At the home of the couple, police have found a lot of pictures and movies where the man and woman expose the girl to cruel abuse. It is heartbreaking to read the judgment.

The couple has now appealed against the verdict of the District Court and requests that their prison sentences be alleviated. The woman has acknowledged 27 of the abuse and claims that the court of appeal dislikes the others she has been convicted of. The man wants the court of law to regard the rape he has been convicted of to be of normal grade instead of coarse. The woman also drives the couple's pecuniary damages of SEK 850 000 to the victim to be reduced to only SEK 380 000 according to the GT.

Prosecutor Robert Beckard makes a different assessment. He wants the court of appeal to judge the couple to the strictest possible sentence that is 14 years in prison. We who protect children's human rights may hope that the court of appeal will listen to the prosecutor.

The verdict of the District Court shows that the girl gained confidence in the man when he worked for her leisure. She was about eight years old. He became the child's contact person and the girl began to live with him and his then girlfriend who was employed as a teacher at the school of the child. The girl enjoyed herself and considered the couple as an extra family and the man became a father figure. But security was a deceptive illusion.

The action has been focused on tampering with and manipulating a minor child, the district court considers that it is a completely unacceptable fraud from the adult world. Over time, the man began to interfere with the girl, a child whom he received the social service blessing to be responsible for. The abuse has occurred on so many occasions that the plaintiff has lost the bill. The district court considers that she is credible, in addition, the photographs and films constitute evidence.

When the girl grew older, she decided to tell her about the mischief of the couple because she was worried that another child would be exposed. Ors are justified. The couple has applied to the professions where they work daily with children in the school world. There is no unusual behavior for pedophiles.

In the judgment, a psychologist estimates that the girl is exposed to a very difficult traumatization. This must be taken seriously. Wounds in the soul can be as serious as physical injuries. It shows the critically acclaimed film "Whitney" who had premiere this summer. Director Kevin Macdonald has tried to investigate the causes of world artist Whitney Houston's premature death at the age of 48 in a bathtub at a hotel in Beverly Hills. The cause of death was determined by drowning with heart disease and drugs as contributing factors.

During the work with the documentary, it appeared that the pop queen as a child had been exposed to sexual abuse by an adult female cousin. Even Houston's brother, who is in life, suffered. Director Macdonald is convinced that the singer's childhood trauma contributed to her lives becoming so turbulent and tragic.
The rule of law should look significantly harder on adults who deliberately add children the trauma. The consequences are often devastating to victims. In May, this leadership page, in connection with another outrageous case law, asked the question: If a lot of rape against a child does not give the maximum penalty, when should the maximum penalty be spent? The question has to be repeated now when the court of appeal is to take a position on the couple's appeal.


Destroying a person's growth must be regarded as something extremely serious, especially in a country proclaimed as a humanitarian superpower by its government. The court of appeal should go on the prosecutor's line and raise the prison sentence of the pedophile, but also the damages seriously. But it's not enough. The legislators must further tighten the penalty scale for this type of crime. A childhood never goes back in reprisal.
