 Several legislative changes in the area of ​​migration from 12 July
On 12 July, adaptations of Swedish regulations to the EU's Migration and Asylum Pact will come into force.

 

 In addition, the possibility of a permanent residence permit for people with asylum-related residence permits will be removed. The legislative changes are based on the Government's Bill on the withdrawal of permanent residence permits and the adaptation of Swedish law to the EU's Migration and Asylum Pact (Prop 2025/26:262).
The division of responsibilities is clarified and screening begins
The bill that is now coming into force clarifies that it is the Police Authority that is primarily responsible for the so-called screening regulated in the EU's Migration and Asylum Pact. The Migration Board has also been appointed as the screening authority and the Migration Board and the Police Authority have therefore signed a joint agreement on cooperation. The agreement regulates how the screening should be carried out, who is responsible for what and how follow-up should be carried out.

– In the areas where the Swedish Migration Board and the Police have joint responsibility for screening, we have now agreed on how it will work in practice. The agreement will come into effect from 12 July and until further notice, says the Swedish Migration Board's Director General Maria Mindhammar.

The screening includes identity checks, security checks, vulnerability checks and a simpler health check that Sweden's regions are responsible for. The screening will start at the Swedish Migration Board's centres in Boden, Märsta/Arlanda, Mölndal and Malmö, where the Swedish Migration Board now shares premises with the Police Authority.

The right to public assistance is limited
From 12 July, the right to free legal advice will change as the law has been adapted to the EU's legal minimum levels. This means that anyone seeking international protection (asylum) has the right to two hours of free legal advice in connection with the start of the application process. If the applicant appeals the Migration Board's decision, the applicant has the right to free public assistance in connection with the appeal.

This is a difference from before, when a person who sought protection in Sweden could have the right to free public assistance from the time the application was submitted.

Permanent residence permits are being phased out
The possibility of a permanent residence permit (PUT) for people with asylum-related residence permits is being removed. This aligns the Swedish regulations with the EU's minimum level.

For those who have applied for asylum and received a temporary residence permit and have applied for a permanent residence permit, the Migration Board will only consider whether the person meets the requirements for an extended residence permit.

People who already have a permanent residence permit are not affected by the change.

  Flera lagändringar inom migrationsområdet från 12 juli
Den 12 juli träder anpassningar av svenskt regelverk till EU:s migrations- och asylpakt i kraft. Dessutom tas möjligheten till permanent uppehållstillstånd för personer med asylrelaterade uppehållstillstånd bort. Lagändringarna bygger på regeringens Proposition om utmönstring av permanent uppehållstillstånd och anpassning av svensk rätt till EU:s migrations- och asylpakt (Prop 2025/26:262).
Ansvarsfördelningen förtydligas och screeningen startar
I propositionen som nu träder i kraft förtydligas att det är Polismyndigheten som är huvudansvarig för den så kallade screeningen som regleras i EU:s migrations- och asylpakt. Även Migrationsverket är utsedd till screeningmyndighet och Migrationsverket och Polismyndigheten har därför tecknat en gemensam överenskommelse om samverkan. Överenskommelsen reglerar hur screeningen ska utföras, vem som ansvarar för vad och hur uppföljning ska gå till.

– I de delar som Migrationsverket och Polisen har ett gemensamt ansvar för screeningen är vi nu överens om hur det hela ska gå till i praktiken. Överenskommelsen börjar gälla från och med den 12 juli och tillsvidare, säger Migrationsverkets generaldirektör Maria Mindhammar.

I screeningen ingår identitetskontroll, säkerhetskontroll, sårbarhetskontroll och en enklare hälsokontroll som Sveriges regioner ansvarar för. Screeningen sätter igång på Migrationsverkets center i Boden, Märsta/Arlanda, Mölndal och Malmö där Migrationsverket nu delar lokaler med Polismyndigheten.

Rätten till offentligt biträde begränsas
Från den 12 juli ändras rätten till kostnadsfri rättslig rådgivning då lagen har anpassats till EU:s rättsliga miniminivåer. Det innebär att den som söker internationellt skydd (asyl) har rätt till två timmars kostnadsfri rättslig rådgivning i samband med att ansökningsprocessen inleds. Om den sökande överklagar Migrationsverkets beslut har den sökande rätt till ett kostnadsfritt offentligt biträde i samband med överklagandet.

Detta är en skillnad mot tidigare då en person som sökte skydd i Sverige kunde ha rätt till ett kostnadsfritt offentligt biträde från det att ansökan lämnandes in.

Permanenta uppehållstillstånd utmönstras
Möjligheten till permanent uppehållstillstånd (PUT) för personer med asylrelaterade uppehållstillstånd tas bort. Därmed anpassas det svenska regelverket till EU:s miniminivå.

För den som ansökt om asyl och fått ett tidsbegränsat uppehållstillstånd och har ansökt om permanent uppehållstillstånd, kommer Migrationsverket bara pröva om personen uppfyller kraven för förlängt uppehållstillstånd.

Personer som redan har ett permanent uppehållstillstånd påverkas inte av förändringen.
